By accessing or using FIKA ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all users of the Service, including administrators, field operators, managers, and any other authorized personnel within your organization.
2. Description of Service
FIKA is an enterprise operational inspection, compliance, and monitoring platform. The Service includes tools for field inspections, SOP audits, asset monitoring, issue tracking, and SLA compliance management across multi-tenant, multi-branch organizations.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes that affect your use of the Service.
3. Account Registration and Security
Access to FIKA is granted by your organization's administrator. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must immediately notify your organization's administrator or FIKA support of any unauthorized use of your account or any other breach of security. FIKA will not be liable for any loss or damage arising from your failure to comply with this obligation.
You may not share your account credentials with any other person or allow any other person to access the Service using your credentials.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that violates applicable laws or regulations, or to transmit any material that is unlawful, harmful, or otherwise objectionable.
You must not attempt to gain unauthorized access to any part of the Service, other accounts, computer systems, or networks connected to the Service. You must not interfere with or disrupt the integrity or performance of the Service.
You are responsible for ensuring that all data you submit to the Service is accurate, lawful, and does not infringe upon the rights of any third party.
5. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
You retain ownership of all data you submit to the Service ("Customer Data"). By submitting Customer Data, you grant FIKA a limited license to store, process, and display that data solely for the purpose of providing the Service to you.
FIKA implements industry-standard security measures to protect your data. However, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee absolute security.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by FIKA and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your organization's internal business purposes. This license does not include the right to sublicense, sell, resell, or commercially exploit any part of the Service.
7. Limitation of Liability
To the maximum extent permitted by applicable law, FIKA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.
In no event shall FIKA's aggregate liability to you for all claims relating to the Service exceed the amount paid by your organization for the Service in the twelve months preceding the claim.
8. Termination
FIKA may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page and, where appropriate, notifying organization administrators by email.
Your continued use of the Service after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.
